Selling Terms & Conditions

General

By becoming a merchant of princessfashionhouse.com website and services you agree to be bound by this agreement. Princessfashionhouse.com trades in accordance with the Trade Practices Act 1974.

Password

When you become a merchant of princessfashionhouse.com, you will be asked to choose a password; please note that you are entirely responsible for maintaining the confidentiality of this password. By accepting our Terms & Conditions, you agree not to use the account, username or password of another member at any time or to disclose your password to any third party. You agree to notify princessfashionhouse.com if you suspect any unauthorised use of your account or access to your password. You are solely responsible for any and all use of your account.

Accepting an order

When an order for your product/s has been received by princessfashionhouse.com, you will receive an automatically generated notification by email from us as soon as the transaction is completed.

This email should be treated as an "Order for supply" and will prompt you to send a confirmation that you have received the email. This email will include the following details:

- Your stock numbers as supplied by you
- A description of goods as supplied by you
- Quantity
- Colour
- Size
- Order value
- Postage costs
- Customer name
- Delivery details
- Customer details
- Our order number
- Our commission charge
- Balance to be forwarded to your account

Payment for supply

Funds for the order are paid by princessfashionhouse.com and not the customer as payment has been received and cleared by us at the time of order placement.

Local transfers

Funds for the order will be deposited into your specified Paypal account within 24 hours of our receipt of the customer order. You will receive an email notification of payment into your account by Paypal. When you have received notification of payment you shall advise princessfashionhouse.com of the shipment date.
You may also view your account details and notifications by accessing your account information on the website.

International transfers

You will be required to set up a Paypal account which allows princessfashionhouse.com to transfer money to your account. We will transfer payment for your goods within 24 hours of receipt of the customer payment converted to your local currency at the exchange rate used by Paypal on the day of transfer.

Your listing upload and commission payment methods

Princessfashionhouse.com takes every precaution to make our site as safe and secure as possible for all members and registered users with all payments secured through the Paypal gateway. (Paypal has no monthy fees and is free to join)

Payment gateway

We use the Paypal payment gateway because it is a trusted and well known payment gateway, providing both you and us with protection, privacy and safety when using both websites.

Internet security technology

We use 128-bit encryption Secure Socket Layer (SSL) web server certificates on this website that encrypts all data sent to and from the website. Information is scrambled and hence unintelligible if intercepted to ensure maximum security. This SSL technology sets the standard for secure data transmission over the Internet. As such, when you reach the final payment stage your connection will change to the secure https channel.

Browser security

If you elect to submit your credit card or direct bank transfer details online, you may notice that the URL prefix located in your address bar will change from the standard http:// to the secure http://. When this happens you are in secure mode; you will also notice at the bottom right-hand corner of your browser either a locked padlock or solid gold key, and, depending on your settings, receive a prompt informing you that you are visiting a secure page. This assures you that your browser and our server are communicating in a secure environment.

General payment options

In abiding by this agreement, you agree to make payment to princessfashionhouse.com for all charges at the prices then in effect for use of the service by you or other persons authorised to use your account, and you authorise princessfashionhouse.com to charge your chosen payment provider for this service.

Currency conversion

When you create a shop and list products for sale within the princessfashionhouse.com website you must ensure that you have chosen the currency that best suits your selling requirements. While princessfashionhouse.com has developed a system to ensure that your listed price less commission is what you receive in your chosen currency we are not liable or responsible for losses that may occur through currency conversion at the time of payment either through Paypal or any other payment means. Currencies provided on the website are indicative only and may vary from the actual real time rates.

Payment methods

You may make payment using the online payment gateway by either:
Paypal
Credit card (Visa, MasterCard and Bankcard)

Commission Structure

By entering into this agreement, you acknowledge that the princessfashionhouse.com service charges a 15% commission for each item sold through the online shopping section to cover costs such as administration, international bank transactions related to providing these services *note: There is no commission on postage chargesYou agree that princessfashionhouse.com will deduct the commission amount from the customer received payment before depositing funds into your account.

When pricing items for sale on the site you should include the commission, packaging and any local taxes if applicable.

Examples of the commission structure and its effect

Supplier to a local Purchaser (Domestic)

(AUD is used in this example)
An item sells for $100 AUD plus $10 AUD postage
You therefore pay the commission on $100 AUD
Commission is 15% which is $15 AUD
In this example you would receive $85 plus the postage refund of $10
Total $95 AUD

Supplier to an international Purchaser (International)
(USD is used in this example)
An item sells for $100 USD plus postage of $20 USD
You pay the commission on the sale price of $100 USD
Commission is therefore 15% of $100 USD which is $15 USD
In this example you would receive $85 USD plus the postage refunded of $20 USD
Total of $105 USD

Possible tax benefits may apply for export and you should check with your accountant or financial advisor

Supply of products

As a member of princessfashionhouse.com, it is your responsibility to ship the products ordered by online customers within the default time of 3 days of receiving an "Order for Supply" notification from princessfashionhouse.com. However we are aware that some products take longer to supply and you are able to specify supply times for each product separately. (Note: If you do not specify a supply time the system defaults to the 48 hours)
You are required to notify princessfashionhouse.com of the dispatch date/shipment date, courier/mail service and consignment number for tracking purposes.

Shipment of products

Suppliers are to ship orders by their specific courier/mail service and are responsible for setting the freight charges for their products. Princessfashionhouse.com has set example default charges which will apply if not altered by youthe supplier . By becoming a supplier you agree to set freight charges in your account settings and are responsible for the updating of those charges or agree to the example default charges set by us. Freight charges are displayed in the currency that you have chosen from the list when setting up your shop.

You must also comply with the listed terms of supply set out below:

  1. Ensuring that the items packed are not damaged and match the order supplied. Any returns because of incorrect or damaged supply will be at your expense including return and replacement freight charges
  2. Ensuring that items are packed to limit the risk of damage
  3. Ensuring that suitable packaging is used
  4. Ensuring that the package is marked with the correct delivery details
  5. Ensuring that the shipment is dispatched using a courier/mail service that provides a parcel tracking service such as registered mail or express post
  6. Dispatch must be within 3 days of receipt of an "Order for Supply" notification unless specified by you

Delivery charges and examples

You are required to set freight charges as per your requirement / cost, however there are a set of example default charges in each sub category which will apply if not altered by you. Each sub category requires a base charge for domestic & international supply plus an additional item charge which when added together will equal your minimum delivery charge. The rates are to be entered in your chosen currency as set when you created your shop. (Note: the default rates displayed are in your chosen currency). Once you have set your sub categories and freight charges you donot have to re-enter them again. The system will automatically use your set freight charges each time you list a product for that category.

Example: Your base rate for selling a dressmight be set at the following rates;

  • Domestic base $8 (Domestic - classed as a supplier from the same country as the purchaser)
  • Domestic additional item $4
  • International base $12 (International - classed as a supplier from outside the purchaser's country of origin)
  • International additional item $6

Therefore if a purchaser is domestic buyer the delivery charge for one dress is $12 (the base charge of $8+1x$4)

If the purchaser buys two dresses then the delivery charge is $16 (the base charge of $8+ 2 x $4)

Or

If the purchaser is an international buyer the delivery charge for one dress is $18 (the base charge of $12+1x$6)

If the purchaser buys two dresses then the delivery charge is $24 (the base charge of $12+2x$6)

We recommend using a courier/mail service that provides freight tracking and that you specify this on your product supply terms and conditions, providing the buyer with delivery concerns a sence of security.

Supplier delivery requirements

Unless specified by you the following delivery times below apply:

Domestic deliveries
5 to 7 days from receipt and processing of the order.
Items from independent suppliers and custom made items may take longer.

International deliveries
7 to 14 days from receipt and processing of the order.
Delivery is dependent upon the you the supplier, items ordered and the delivery destination. Items from independent suppliers and custom made items may take longer and should be specified.

International supply disclaimer

You will notice that a disclaimer is provided for the benefit of yourself and princessfashionhouse.com, which specifies that you and princessfashionhouse.com will not be held responsible for any additional taxes, customs charges etc incurred by the customer in regards to their local customs procedures. If a customer does not accept any additional taxes charged, the order is returned and the customer is refunded an amount less the extra freight charges.

Post office boxes

For security reasons Post office boxes are not accepted as a delivery address and the order will not be processed. All deliveries must be accepted in person.

Product availability

Princessfashionhouse.com promotes and sells products on your behalf; therefore, we are reliant upon you to make every effort to ensure the accuracy of the inventory listed. If a product becomes unavailable, a 'sold out' sign will be placed automatically on the listed item and you will be notified. If there has been an error in inventory and the item is sold out before being marked sold out on the website, we are to be notified within 24 hours of you receiving an 'Order for Supply'.The notification must consist of the order number & customer name with the solution of either a delayed supply or refund arrangement to be made.

Returns & exchanges

Ensuring that our customers are 100% satisfiedand feel comfortable to shop on the website is of the utmost importance to the princessfashionhouse.com team. We understand that each of you have your own refund and exchange policy which must be displayed on your products for sale. If you do not display a sale terms policy your products will not be listed.princessfashionhouse.com has provided a default example policy which you may delete, edit or insert your details to suit your requirements. Princessfashionhouse.com will not be liable for any incorrect sale terms and you the supplier are soley responsiblefor the accuracy of those terms. By agreeing to these terms & conditions you agree that you will supply your own sale terms for product sales and that princessfashionhouse.com has no liablity or responsiblity for your product, refunds, exchange, warranty, freight costs and sale terms.

The example sale terms default policy is set out below:

Making a return

If you are dissatisfied with the product received you must contact (insert your name here) through the princessfashionhouse.com website within 7 days of receiving the product to receive a Returns Advice Number (RAN). You may contact us by visiting our profile page within the princessfashionhouse.com website and sending us an email. You will be required to advise us of your name, address, phone number, email address, product detail, order number, paypal, bank or credit card details and the reason for return, you may also advise us of your preferred option: either refund or exchange.

You may then return the product to us at this postal address (insert your address here) within 7 days from receiving the Returns Advice Number (RAN)

If we do not receive a response within the initial 7-day period, or receive the returned item within 7 days of our advice, you shall be deemed to have waived any right that you may have had to return the item and shall thereafter have no further right to return the item or claim a refund.

When returning items there must be no marks or any sign of wear and tear with all tags still attached. Shoes must be returned in the original box and have no sign of wear and tear.

(insert your name here) will not be held responsible for the item being returned to us getting lost or stolen during transport. We do not accept for refund or exchange any item that we suspect has been damaged through wear and tear. Items must be in an unused and unworn condition with all tags still attached.

Refunds

The amount refunded will depend on the reason for the return. If you have received a damaged item or the wrong product, we will refund the original item cost and the delivery cost (You return the item to us at your own expense as you would normally do when returning an item purchased in-store). If you are returning an item that you no longer wish to purchase then only the item cost will be refunded.

We will refund you within 30 days from receipt of the returned product.

Exchanges

Exchanges work in the same way as making a return. You should advise us that you would prefer to exchange the product by contacting us as per making a retrun. If there is any variance in the price of the item involved in the exchange we will advise you of the amount and how we will either refund or charge them accordingly.
You return the item to us at your own expense and will be charged an additional delivery charge for the new product.

International
For international returns and exchanges all of the above conditions still apply.
Items to be returned to an international supplier should be sent no slower than registered air mail and must be marked 'Return of Goods'. The customer will be required to pay for the return freight charges; in the case of an exchange, an additional delivery charge will apply.

Sales, Clearance & Custom made products
There are no refunds or exchange on sale, clearance or custom made items sold through the website.

Website & product displays

You agree that by becoming a member of princessfashionhouse.com that you will provide content of a high standard as set out below when displaying items for sale and creating your website pages.

  • Photo's must be of a good standard so buyers can see exactly what they are buying
  • Product information and description, such as sizes available, colours, quantity available etc is your responsibility and shall be listed as accurately as possible
  • Clothes displayed should be either displayed on a model or mannequin.
  • Items displayed lying on the floor are viewed by us as unacceptable

Price changes

By entering into this agreement, you acknowledge that princessfashionhouse.com reserves the right to introduce new prices and charges and increase fees at anytime for future terms as specified in the following section of 'Term & Termination'.

Term & termination

There is no set term for membership and you may terminate (cancel) your membership at any time. If you are selling items online through the pincesssfashionhouse.com website we request that you provide notice of your intent to terminate for no less than 30 days for the purpose of advising users and ensuring that all transactions are completed.

You are not to use or reproduce any copyrighted material such as trading names, trademarks, logos or other proprietary information belonging to princesfashionhouse.com, Princess Enterprises Australia Pty Ltd or subsidiaries for any reason without our written permission. All materials and content on the website are protected under International Copyright Law. Copyright of all boutique, graduate & individual designer collections & portfolios remain the copyright and property of those respective owners unless stated otherwise. All third party trademarks, mentions or displays are the property of their respective owners.

Intellectual property

All content on the princessfashionhouse.com website apart from the boutiques, graduates, independent designers and user submissions (content) including, but without limitation to: text, software, photos, graphics, sounds, music, video, interactive features, name, trademarks, logo's contained within the website are owned by princessfashionhouse.com. Content on the website is for personal use only and may not be used, copied, reproduced, distributed, displayed or exploited for any other purposes without the prior written consent of the respective owners.

Changes to agreement

By entering into this agreement, you agree that these terms and conditions may be changed at any time. You agree that minor changes will be effective immediately. You are bound by any minor changes; however, any major changes will be issued to you prior to being implemented. You acknowledge that you have the right to either agree or disagree with those changes and that those changes cannot be implemented to your agreement without your written consent.

Indemnity

By entering into this agreement, you agree to indemnify and hold princessfashionhouse.com, its parent company, subsidiaries, affiliates and their respective officers, directors, agents, partners and employees free from all actions, claims, costs, legal costs and expenses, losses, damages, liability, or demands made by any party due to your use or connection with the princessfashionhouse.com website and services.

Website access

Princessfashionhouse.com grants you permission to use the website as per this agreement. You acknowledge that at times the site may be restricted or inaccessible due to certain circumstances and that princessfashionhouse.com will not be made liable in those instances for any losses or damages.

The princessfashionhouse.com site contains links to other websites that belong to other parties and which we do not have any control over. Princessfashionhouse.com is not responsible, cannot endorse and is not liable for any content, products or services made available on those sites. You agree that princessfashionhouse.com cannot be made liable for any loss or damage caused by the use of other affiliated sites.

Our liability

In no event shall princessfashionhouse.com be liable to you or any third party for any direct or indirect damages, including loss of profits, damages arising from your use of the website or services, special damages, loss of data, loss of business, consequential or incidental loss, even if we have been advised of the possibility of such damages.

Your data (use & protection)

Princessfasionhouse.com collects your submitted information for the purpose of providing this service. We will not allow third parties to access your personal information and payment details; however, in abiding by this agreement, you agree that certain information is made public for the purpose of promoting you and your business. Force majeure

Princessfashionhouse.com shall not be liable for any delay in performing any of its obligations under this agreement if such delay is caused by circumstances beyond the reasonable control of princessfashionhouse.com, and we shall be entitled to a reasonable extension of time for the performance of such obligations.

Disputes and applicable law

If there is any dispute about or involving the princessfashionhouse.com website and services, you agree that the dispute will by governed by Australian Consumer law. Any dispute in relation to these conditions and the use of the website and services will be heard in the State of South Australia and resolved in accordance with Australian law.

Privacy policy

You acknowledge that the site and services of princessfashionhouse.com is governed by our privacy policy, which you have read and understood. Please review our privacy policy if you have not yet done so.

Taxation

All prices should include any taxes applicable in their country of origin. Generally export sales are tax free with the customer being liable for any duties or taxes according to their local customs authority. Princessfashionhouse.com takes no responsibility and does not accept any liability for the tax requirements of suppliers. We recommend that you seek your own advice in your country of origin in regards to your local taxes and customs requirements
